Surgical Error Gastric Bypass Lawsuit in New York Medical Malpractice Claims
Weight loss surgery has become increasingly common as obesity rates continue to rise across the United States. While gastric bypass procedures are generally considered safe, serious complications can occur when a surgical mistake is made.
Alleged Surgical Error During Gastric Bypass Procedure
In a reported case outside of New York, a man weighing approximately 275 pounds underwent gastric bypass surgery in hopes of improving his health and quality of life. Instead, the outcome was devastating. Following the procedure, he lost both of his legs.
According to allegations, the surgeon punctured the patient’s main artery early in the operation. The error caused the man to lose nearly four liters of blood, requiring emergency blood transfusions to stop the bleeding. At the time, it was not recognized that the artery that had been punctured was the aorta.
Loss of Blood Flow and Resulting Amputations
Once the artery was closed, blood flow to the patient’s lower extremities was reportedly cut off. Without oxygen-rich blood, the legs could not maintain warmth or circulation. The prolonged lack of blood flow caused severe tissue damage, ultimately resulting in the amputation of both legs.
When the patient awoke weeks later, he learned that not only had the gastric bypass surgery not been completed, but he had also suffered the permanent loss of his lower limbs.
Known Risks and Preventable Errors in Bariatric Surgery
While bariatric surgery carries known risks, catastrophic outcomes are often preventable when proper surgical technique and monitoring are followed. According to the National Institute of Diabetes and Digestive and Kidney Diseases, gastric bypass surgery can lead to serious complications such as bleeding, blood clots, and damage to surrounding organs when errors occur during surgery.
Legal Options for Victims of Surgical Errors in New York
Even during routine procedures, unexpected complications can arise. However, when injuries result from careless or negligent surgical conduct, patients may have grounds for a surgical error gastric bypass lawsuit in New York. These claims may seek compensation for medical expenses, permanent disability, pain and suffering, and long-term care needs.
